ESMA Finalises Clearing Exemption Rules for Risk-Reduction Services
On 20 October ESMA published its Final Report (ESMA74-1049116226-981) with draft technical standards setting the conditions post-trade risk reduction (PTRR) services must meet for trades to benefit from the EMIR 3 clearing-obligation exemption. The draft RTS now go to the European Commission for endorsement and apply once adopted and in force.
Why It Matters
EMIR 3 introduced a clearing-obligation exemption for trades resulting from PTRR exercises such as portfolio compression and rebalancing. These RTS are the operative detail: they set the conditions and safeguards for the exemption, plus requirements on the PTRR service providers and the counterparties that use them. ESMA developed them after its 26 February 2026 consultation.
The standards are not yet binding. They await Commission endorsement, so there is time to prepare. Counterparties that use PTRR services, and the providers themselves, can now see the final conditions and test their processes against them.
Also today: the OCC issued its final rule implementing the GENIUS Act (see below), and ESMA's revised MAR guidelines on delaying disclosure of inside information are final.
Action Items
Read the Final Report — Compare the RTS conditions for the clearing exemption with how your PTRR exercises are run today.
Map your PTRR exposure — List the counterparties, providers and trade types that rely on the exemption, so you know what documentation and controls are needed.
Track Commission endorsement — The RTS apply only once adopted and in force; put the Commission step on your regulatory calendar.
