South Korea's PIPA Overhaul Takes Effect in 10 Days

South Korea's amended Personal Information Protection Act takes effect on 11 September 2026 — 10 days away — adding a penalty tier of up to 10% of total turnover and naming the CEO as ultimately responsible for data-protection compliance.

Why It Matters

This is the sharpest escalation in Asia-Pacific privacy enforcement this year. The existing up-to-3% baseline fine stays, but a new tier of up to 10% of total turnover now applies to the worst cases: repeat violations within three years involving intent or gross negligence, single incidents affecting 10 million or more individuals, or breaches that follow a failure to comply with a PIPC corrective order.

The CEO-accountability provision changes the internal conversation. Data protection is no longer something a DPO owns alone — the chief executive is formally on the hook, which is exactly the framing that moves budget and board attention.
