CFTC Opens the First US Inquiry Into "Compute" Derivatives

The Commodity Futures Trading Commission has become the first US markets regulator to move on a brand-new asset class: derivatives priced on compute — the cost of AI and data-center computing capacity. On August 19, 2026 the CFTC issued a request for comment (Release 9286-26), asking how deep the underlying cash markets are, how to guard against manipulation, how customers should be protected, and how to treat perpetual compute futures.

Chairman Michael S. Selig called a functioning compute-derivatives market strategically important to US competitiveness in AI. This is a pre-rulemaking inquiry — no product is approved and no standard is set — but it signals the CFTC intends to build a listing and oversight framework. Comments are open for 60 days after the notice publishes in the Federal Register (expected mid-to-late October).
