Is Your Stack Ready for the EU AI Act's Aug 2 Cliff?

On August 2, 2026, the bulk of the EU AI Act (Regulation (EU) 2024/1689) becomes fully applicable — and the enforcement teeth switch on. GPAI provider obligations have applied since August 2025, but the European Commission's power to fine GPAI providers under Article 101 begins only now: up to €15M or 3% of worldwide annual turnover (prohibited-practice fines under Article 5 reach €35M or 7%). The same date triggers the Article 50 transparency duties — labelling AI-generated content and disclosing chatbots and deepfakes — and requires every Member State to have designated its competent authorities and stood up at least one regulatory sandbox. High-risk obligations remain deferred to December 2, 2027 and August 2, 2028 under the Digital Omnibus.

California's AI Transparency Act (SB 942) goes operative the same day. Amendment AB 853 pushed the operative date to August 2, 2026. Covered generative-AI providers with over one million monthly California users must offer a free public AI-detection tool and embed latent and manifest disclosures in AI-generated image, video, and audio. Civil penalties run to $5,000 per violation per day, enforced by the Attorney General. Confirm your detection tool and provenance disclosures are live for California users before August 2. Source

Illinois enacts the first US mandatory frontier-AI audit law. Governor Pritzker signed SB 315 on July 6 — the first US state law requiring independent third-party safety audits of frontier models. It applies to developers training above 10^26 operations (with the toughest duties on developers over $500M revenue), takes effect January 1, 2027, and phases in audit and transparency reporting from January 1, 2028. Penalties reach $1M for a first violation and $3M thereafter. Scope whether your models cross the compute threshold and budget for an external audit function. Source

Ireland races to stand up its AI Office by August 1. The Regulation of Artificial Intelligence Bill 2026 — which creates the AI Office of Ireland as lead authority — cleared its Dáil stages on June 30 and is now before the Seanad. The office is targeted to be operational by August 1, one day ahead of the EU market-surveillance deadline; Ireland already designated 15 national competent authorities last September. Source

FTC comment window closes July 31. The Federal Trade Commission's proposed policy statement on "suppression of accuracy" in AI systems is open for comment until July 31. The draft floats federal preemption of state laws that compel alteration of truthful AI outputs — a signal worth weighing against the growing stack of state AI statutes. Decide by July 31 whether to file a comment on the preemption framing. Source

If you deploy generative AI into the EU or California, lock your August 2 readiness list now: Article 50 / SB 942 transparency labelling live, GPAI technical documentation and training-data summaries ready, and a named accountable owner for each. Twenty-five days is not much runway for a labelling change across production systems.
